PART 1: PRIVACY POLICY

1. Executive Summary & Scope

This Privacy Policy governs the access, installation, and utilization of NexoMind ("the Application"), developed and published by Teklin Software Labs ("the Developer", "we", "our", or "us"). We operate under an absolute Zero-Data Collection & Privacy-First Architecture. The Application does not collect, record, harvest, transmit, process, share, or sell any personal data, device identifiers, or behavioral telemetry under any circumstance.

2. Zero Network Connectivity & Zero Third-Party Trackers

No Network Permissions: The Application does not request or possess the Android android.permission.INTERNET or android.permission.ACCESS_NETWORK_STATE permissions.
No Remote Telemetry: The Application contains zero third-party analytics SDKs (e.g., Firebase Analytics, Adjust, AppsFlyer), zero advertising networks (e.g., Google AdMob, Unity Ads), and zero surveillance or behavioral tracking libraries.
Offline Execution: 100% of all computational game logic, sequence generation, and score calculations occur locally on the physical silicon of the user's device.

3. Local Data Storage & User Sovereignty

Sandbox Storage: All in-game progress metrics (e.g., levels completed, high scores, coins, unlocked vanity assets, achievement badges, sound preferences, and speed modifiers) are stored exclusively in an encrypted, sandboxed local key-value store (Hive CE) on the physical device.
Developer Inaccessibility: The Developer possesses no remote access, server connection, or back-door keys to the local user database.
Data Erasure: Users retain absolute sovereignty over their data. Uninstalling the Application or clearing the app cache/storage via Android System Settings permanently and irrevocably deletes all local data records.

4. International Regulatory Compliance

A. European General Data Protection Regulation (GDPR / UK-GDPR)

Under GDPR Articles 13, 14, and 21:

The Developer does not act as a Data Controller or Data Processor because no personal data is collected or processed.
No data is transferred across international borders.

B. California Consumer Privacy Act (CCPA) & CPRA

No Sale or Sharing of Personal Information: We have not sold, shared, rented, or disclosed any personal information to third parties in the preceding 12 months, and we will never do so.
Categories of Data Collected: None.

C. Children's Online Privacy Protection Act (COPPA) & Google Play Families Policy

NexoMind is designed for general audiences. The Application does not knowingly solicit, capture, or store any personal information from children under the age of 13 (or under 16 in the European Union).
The Application contains zero behavioral advertising, chat features, or open user communications.

PART 2: TERMS OF SERVICE & LIMITATION OF LIABILITY

1. Acceptance of Terms & Capacity

By installing, downloading, updating, or using NexoMind, you irrevocably agree to be legally bound by these Terms. If you do not accept these Terms in full, you must immediately uninstall and discontinue all use of the Application.

2. Intellectual Property Rights & License Grant

Limited License: Teklin Software Labs grants you a revocable, non-exclusive, non-transferable, non-sublicensable, personal license to use the Application solely for personal, non-commercial entertainment.
Proprietary Rights: All software code, graphical user interfaces, visual effects, logos, audio compositions, and trademarks are the exclusive proprietary intellectual property of Teklin Software Labs.
Strict Prohibitions: You shall not reverse-engineer, decompile, disassemble, modify, extract source code, distribute, lease, sell, or create derivative works of any part of the Application.

3. Absolute Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH ALL FAULTS AND DEFECTS.
THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE DEVELOPER MAKES NO WARRANTY THAT THE APPLICATION WILL BE UNINTERRUPTED, SECURE, BUG-FREE, OR COMPATIBLE WITH EVERY DEVICE HARDWARE OR FUTURE ANDROID OPERATING SYSTEM ITERATION.

4. Maximum Limitation of Liability & Damage Cap

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW:

Exclusion of Damages: IN NO EVENT SHALL THE DEVELOPER, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, LOSS OF GOODWILL, HARDWARE MALFUNCTION, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE APPLICATION.
Aggregate Liability Cap: IN ALL CASES, THE DEVELOPER'S ENTIRE AGGREGATE LIABILITY UNDER ANY PROVISION OF THESE TERMS SHALL BE STRICTLY LIMITED TO AND CAPPED AT ZERO DOLLARS ($0.00 USD) OR THE ACTUAL AMOUNT PAID BY THE USER DIRECTLY TO THE DEVELOPER FOR THE APPLICATION IN THE PRECEDING THREE (3) MONTHS (WHICHEVER IS LESS).

5. Medical, Clinical & Cognitive Disclaimer

Recreational Entertainment Only: NexoMind is an interactive puzzle game created purely for casual entertainment and cognitive recreation.
No Medical Claims: The Application is not a medical device, medical therapy, psychological clinical tool, or diagnostic software.
No Health Guarantees: The Developer makes no guarantees regarding memory improvement, cognitive enhancement, or the prevention, mitigation, or treatment of any neurological disorders, including Alzheimer's disease, dementia, ADHD, dyslexia, or general age-related cognitive decline.
Vanity Scoring: In-game score rankings, levels, and "IQ estimations" are purely arbitrary in-game vanity progression metrics that bear zero scientific correlation to standardized clinical IQ assessments.

6. Photosensitivity, Seizure & Screen Time Warning

A very small percentage of individuals may experience epileptic seizures or temporary blackouts when exposed to certain light patterns, visual sequences, or flashing lights. If you or anyone in your household has an epileptic condition, consult your physician prior to playing. Immediately discontinue use and seek medical attention if you experience dizziness, altered vision, eye/muscle twitching, or loss of awareness.

7. Binding Dispute Resolution & Class Action Waiver

Individual Arbitration / Relief: You agree that any legal dispute, controversy, or claim arising out of or relating to this Application or these Terms shall be resolved exclusively on an individual basis.
Class Action Waiver: YOU EXPRESSLY WAIVE ANY RIGHT TO COMMENCE, MAINTAIN, JOIN, OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING AGAINST THE DEVELOPER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Teklin Software Labs, its officers, employees, and affiliates from and against any third-party claims, liabilities, losses, damages, costs, and legal fees arising out of your misuse of the Application or breach of these Terms.

9. Governing Law & Jurisdiction

These Terms and Privacy Policy shall be governed by and construed in accordance with the laws applicable to consumer mobile software, without regard to conflict of law principles.
